1. Acceptance of Terms

By accessing or using the Hero365 platform and related services (the "Service") provided by Hunter Apps, Inc. ("Hero365," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

Hero365 is an AI-powered operating system for home-services businesses, providing scheduling, CRM, invoicing, estimates, dispatch, communication tools, AI agents, and business website hosting. The Service is delivered through web applications, mobile applications, and APIs.

3. Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information and keep it updated.

You may invite team members to your business account. As the account owner, you are responsible for the actions of all users you authorize.

4. Subscription and Payment

The Service is offered under subscription plans with varying features and limits. Pricing is available at hero365.ai/pricing. By subscribing, you authorize us to charge your payment method on a recurring basis.

  • Trial Period: Some plans may include a short trial period. Details and duration are shown at the time of signup.
  • Billing: Subscriptions are billed monthly or annually in advance. All fees are non-refundable except as required by law.
  • Cancellation: You may cancel your subscription at any time. Access continues until the end of the current billing period.
  • Price Changes: We may adjust pricing with 30 days' notice. Continued use after a price change constitutes acceptance.

5. Your Data

You retain all ownership rights to the data you upload or create in the Service ("Your Data"). You grant Hero365 a limited license to host, process, and display Your Data solely to provide the Service.

You are responsible for the accuracy, legality, and appropriateness of Your Data. You must have the necessary rights and consents to store customer information and send communications through the platform.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Send spam, unsolicited communications, or harassing messages through the platform
  • Attempt to gain unauthorized access to other accounts or systems
  • Interfere with the operation or security of the Service
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Resell or sublicense access to the Service without written permission
  • Use the Service to store or transmit malicious code

7. Third-Party Integrations

The Service integrates with third-party services including Google (Calendar, Gmail, Maps, Business Profile), Stripe, Telnyx, and others. Your use of these integrations is subject to the respective third-party terms and privacy policies. Hero365 is not responsible for third-party service availability or performance.

8. AI-Powered Features

The Service includes AI-powered features such as voice agents, content generation, scheduling optimization, and business insights. AI-generated outputs are provided as suggestions and may not always be accurate. You are responsible for reviewing and verifying AI outputs before acting on them.

9. Business Websites

The Service may host a website for your business. You are responsible for ensuring your website content complies with applicable laws, does not infringe third-party rights, and is accurate. We may remove content that violates these Terms.

10. Intellectual Property

The Service, including its design, code, features, documentation, and branding, is the property of Hero365 and is protected by intellectual property laws. These Terms do not grant you any rights to Hero365's intellectual property except the limited right to use the Service as intended.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, HERO365 DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HERO365'S TOTAL LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. HERO365 SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

13. Indemnification

You agree to indemnify and hold harmless Hero365 and its officers, directors, employees, and agents from any claims, losses, or damages arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

14. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases, but provisions that by nature should survive will continue to apply.

You may export Your Data at any time during your active subscription. After account deletion, we retain Your Data for 30 days before permanent deletion.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.
